Persecution versus Prosecution in Asylum Cases under International Law & Municipal Laws

Abstract
In light of the 2017 GCC Crisis, the right to political asylum has gained special importance for the governments and countries in the region. Qatar issued a law - unique of its kind - regulating the right to political asylum, after the accusations it faced - during the Gulf crisis - of embracing a group of individuals who belong to groups of thought classified as terrorist or extremist organizations by neighboring countries. Given the newness of the law and the contemporary regional controversy around it, this study deals with one of the legal bases for granting political asylum in international law: the existence of a well-founded fear of persecution. When a country receive political asylum request, it shall determine whether the case is of a persecution or a legitimate prosecution.
The study examines the standards to differentiate between persecution and prosecution in cases of political asylum through an analytical study of international law standards, and the provisions of internal laws with a specific focus on the Qatari law.
