Abstract

Relations between states are governed by a set of rules, which stem from international law embodied in treaties and customary law. When a state violates its international obligations, it may result in a legal liability provided that certain conditions are satisfied. Therefore, state responsibility is established when a state commits an internationally wrongful act that causes damage to another state. As a result, the latter receives compensation for the damage it has suffered from the responsible state’s acts.


The world is experiencing a global health crisis from the Covid-19 virus, which led to the adoption of emergency laws by states that restricted some human rights guaranteed by international law. Contractual and legal obligations stemming from treaties concluded between states suspended as well. It raises ramifications of international law violations committed due to public health exigencies. The extent to which measures taken by states to combat the virus violate international law is however unclear.


This article reviews provisions of state responsibility; and examines the legality of actions taken by states to combat the pandemic. In addition, an analysis given on whether the Covid-19 pandemic can be classified as a circumstance precluding wrongfulness under the Articles on Responsibility of States for Internationally Wrongful Acts of 2001.
