الملخص
تسعى الأطراف المتعاقدة المسؤولة عن المخاطر، بموجب عقود البترول، إلى التخلّي بشكل جذري عن افتراضات القانون العام، فيما يتعلّق بتوزيع المخاطر، بموجب أحكام القانون العام. ومن يقوم بخرق أي التزام عقْدي، أو قانوني معيّن؛ تقع عليه المسؤوليّة، بقدر الخطأ المرتكب، وبالتالي وجب التعويض للمتضرر. لكن هذه ليست الحال دائمًا في صناعة البترول، حيث تُخصَّص المخاطر على الطرف الأكثر قدرةً على التحكّم في هذا الخطر. في هذا الصدد، يستخدم الطرفان العقد لتقليل احتماليّة المخاطر، أو السيطرة على عواقب هذا الخطر. ويتم الترتيب لأحكام المخاطرة إمّا في اتفاقية بين المشغّل والمقاول، أو بين أطراف اتفاقيّة التشغيل المشترك. تناقش هذه الورقة البحثيّة توزيع مخاطر عقود صناعة البترول فيما يتعلّق بممارسة نموذج اتفاق "Knock-for-Knock".
