Assessing Re-Purchase Agreements as the Solution for Troubled Islamic Financial Institutions in light of Islamic Jurisprudence
Abstract
This is a scientific study which addresses the (Assessing the Remedy of Troubled Islamic Financial Institutions Using Re-Purchase Agreements in Light of Islamic Jurisprudence Provisions). I have divided the study at hand into three chapters. In the introduction chapter I present a definition of distress in financial institutions. I attempt to present the difference between distress compared to bankruptcy and insolvency. The other two chapters deal with the core issues of the study. The first chapter among other issues provides a definition of the re-purchase agreement along with its different types. In the second chapter, I provide two forms of re-purchase agreements executed by some Islamic financial institutions. The first form documents the sale of securities to another party with a promise from buyer to sell to the seller. The second form represents securitizing of asset~ and debts and their sale under a promise from the buyer to resell the same.
