الملخص

أصبحت الشراكة بين القطاعين العام والخاص تقنية استراتيجية لا غنى عنها في جميع أنحاء العالم لتوفير الرعاية الصحية، من خلال تعبئة قدرات القطاع الخاص المالية والتكنولوجية وكفاءته الإدارية، فضلًا عن الاستجابة للنزعة العالمية في تقليص حجم الدولة. ومع ذلك، فإن تصميم هذه الشراكات وتنفيذها ليس بالأمر الناجح دائمًا، نظرًا لتباين القيم والأهداف والأطر التنظيمية والقانونية التي يتبناها الشركاء.


يهدف البحث إلى استعراض أبرز الأساليب القانونية للشراكة في المجال الصحي، ثم يقترح أفضل السياسات والدروس والتوصيات المستقاة من التجارب العالمية لتحقيق شراكة ناجحة.


وقد أظهرت النتائج أن الدول تستخدم طيفًا واسعًا من التقنيات القانونية لإشراك القطاع الخاص في تقديم الرعاية الصحية، مثل عقود البنية التحتية، وعقود الامتياز، وعقود تقديم الخدمات الصحية المتكاملة، وصولًا إلى خصخصة القطاع برمته، كما أظهر البحث بأن الشراكات الناجحة تتطلب الإنجاز الدقيق لمرحلتين أساسيتين هما، التحضير للشراكة، وتنفيذ الشراكة؛ حيث تحتاج مرحلة التحضير إلى تشخيص مسبق للقطاع الصحي في الدولة، وإلى تحضير البيئة الملائمة لنجاحها سياسيًا واجتماعيًا، وإلى إرساء الإطار القانوني والمؤسساتي، أما مرحلة التنفيذ فتتطلب ذاتية اختيار أسلوب الشراكة، والاستعانة بالخبرات العالمية، وتأمين الجدوى الاقتصادية، وتغطية مخاطر الطلب والتضخم، فضلًا عن حماية الفقراء وضمان الرقابة والمساءلة.
